Increase Granted for New Occupant

Landlord applied for an increase in rent-controlled tenant's rent based on increased occupancy. The DRA ruled for landlord and increased tenant's monthly rent by $71. Tenant appealed, claiming that when she moved in there were four occupants. In 1980, after her husband died and her children left, another person moved in with her. So now there were only two occupants. The DHCR ruled against tenant. Since the new occupant wasn't one of the original occupants, the DRA correctly granted a rent increase based on additional occupancy.
