Inconsistencies in Landlord's Documentation

Landlord claimed that the DRA disallowed a rent increase for various improvements made to the apartment before tenant moved in. The DHCR ruled against landlord. There were inconsistencies in the documentation of some of the items listed in landlord's prior submissions.

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord claimed that the DRA disallowed a rent increase for various improvements made to the apartment before tenant moved in. The DHCR ruled against landlord. There were inconsistencies in the documentation of some of the items listed in landlord's prior submissions. For example, the range hood cited the wrong address and cited no apartment number, the labor costs associated with bathroom improvements cited no apartment number, and the bathroom re-tiling and the costs associated with that re-tiling cited the wrong apartment number. So, the DRA had properly disallowed the cost of these items in calculating a 1/40th rent increase for the apartment.
