Income Information of One Tenant Missing

Landlord applied for high-rent/high-income deregulation of tenant's apartment, because the rent was $2,000 or more per month. The DRA ruled against landlord, finding that tenant's household income was less than $250,000 for the two prior years. Landlord appealed, claiming that DHCR got income verification from the NYS Dept. of Taxation and Finance for only one of the apartment's two tenants. Tenants didn't answer landlord's PAR. The DHCR ruled for landlord and sent the case back for further fact finding concerning the incomes of all tenants of the apartment.
