Landlord applied for high-rent/high-income deregulation of tenant's apartment since the monthly rent was $2,000 or more and landlord claimed that tenant's annual household income was over $250,000 in each of the two prior calendar years. The DRA ruled against landlord, finding that tenant's household income was below the income threshold for the period in question. Landlord appealed, claiming that the DRA didn't verify the income of all household occupants. The DHCR ruled for landlord and sent the case back for further fact-finding.
