Illegal Bathroom Installed Before Landlord Bought Building

DOB issued a violation notice to landlord for altering a one-family house without a permit. In addition to SRO units, DOB's inspector found a three-piece bathroom containing a toilet, sink, and shower that was installed without a permit. Landlord claimed that the bathroom was there when she bought the building. The ALJ ruled against landlord and fined her $800. Landlord appealed and won. There were approved 2006 plans on file with DOB for the installation of a bathroom with a bathtub, not a shower. And landlord credibly testified that the bathroom was there when she bought the building.
