Husband Can't Seek Succession Rights Until Current Renewal Lease Expires

LVT Number: #26048

Rent-stabilized tenant's husband complained that landlord refused to give him a renewal lease in his own name after tenant moved out of the apartment permanently.  The husband claimed he had succession rights. The DRA ruled against the husband, who appealed and lost. Tenant had signed a renewal lease for the period commencing June 1, 2013, and ending on May 21, 2015. The DRA had correctly ruled that the husband's complaint was premature. The husband could file a complaint for a renewal lease only after the current renewal lease expired.
