HPD Sets New Rent for Tenant

Tenant complained of a rent overcharge. He said that his rent increased drastically in March 2008 while a DHCR rent reduction order was in effect. The DRA ruled against tenant, finding no overcharge. Tenant appealed and lost. With his complaint, tenant submitted an order from HPD that set tenant's rent at $765 per month effective Feb. 1, 2008. Under Rent Stabilization Code Section 2521.1(d), HPD sets the initial rents in buildings subject to loans received under the Private Housing Finance Law.

The rent set by HPD under the order shown by tenant superseded tenant's prior rent-stabilized rent and wasn't subject to challenge before the DHCR.
