HPD Removes One Rent-Impairing Violation

LVT Number: #19935

Landlord filed for 2006-07 MBR increases, stating that all rent-impairing violations and at least 80 percent of nonrent-impairing violations were cleared. The DRA ruled for landlord. Tenant appealed, claiming that there were 170 violations on record for the building. The DHCR ruled against tenant. The DHCR inspector found one rent-impairing violation at the building. It was an illegally installed wash basin that couldn't be restored to working condition. An HPD inspection followed shortly thereafter and the violation was removed.

Landlord otherwise had cleared enough nonrent-impairing violations to qualify for MBR increases.
