How to Register Apartment Deregulated After J-51 Benefits End

LVT Number: 9529

Landlord asked the DHCR how to register apartments after J-51 tax benefits expire. In an opinion letter, the DHCR stated that when an apartment becomes deregulated because J-51 benefits expire, landlord should advise the DHCR of the deregulation on the first annual registration statement occurring after the deregulation. For example, on the 1994 annual apartment registration, landlord should indicate deregulation in Item 7b. Landlord needn't file an amendment to a previously submitted registration.

Landlord also should change the number of rent-stabilized and permanently exempt apartments that appear on the annual building registration summary.
