Hot Water Temperature Adjusted

Tenant complained of a reduction in services based on lack of hot water. The DRA ruled for tenant and reduced her rent. Landlord later applied for rent restoration based on restoration of services. The DRA ruled for landlord. Tenant appealed, claiming that her complaint was that the water temperature fluctuated from cold to scalding hot. The DHCR ruled against tenant. An inspection showed that the hot water was above the minimum required.

The DRA ruled for landlord. Tenant appealed, claiming that her complaint was that the water temperature fluctuated from cold to scalding hot. The DHCR ruled against tenant. An inspection showed that the hot water was above the minimum required. And the DRA's rent reduction order was based on a finding that the hot water was insufficient, not that the water temperature fluctuated from too cold to too hot. Tenant never appealed the DRA's decision. So tenant couldn't raise that claim in response to landlord's application to restore rent.
