Landlord asked the DHCR if a hot water dispenser (HWD) installed as part of a kitchen sink and holding up to a half gallon of water would qualify as an individual apartment improvement warranting a rent increase for a rentcontrolled apartment. In an opinion letter, the DHCR stated that this appliance would probably qualify as an apartment improvement for which a rent increase could be collected. The DHCR pointed out that a rent increase for apartment improvements Can be collected from rent-controlled tenants only if tenants consent in writing.
