Heating System Not Accessible to Inspector

DEP issued a violation notice to landlord for not making the heating system accessible to an inspector. The inspector stated that no signs were posted as to where the boiler room keys or super could be found. Landlord claimed a sign was posted over the mailboxes in the building's lobby indicating a tenant had the boiler room key. Landlord claimed vandals had removed the previous sign from outside the building and that DOB told him to post it inside. ALJ ruled against landlord and fined him $265. Landlord appealed. ECB ruled against landlord.
