Hearing Required on Base Date Rent

Tenant complained of a rent overcharge. The DRA ruled for tenant but found only a $200 overcharge. Tenant appealed. Tenant questioned landlord's base date rent documentation and pointed out that landlord's 2001 rent ledger indicated that prior tenant was paying rent to landlord in December 2000, when he didn't move into the apartment until May 2001. Tenant claimed fraud. The DHCR ruled for tenant and reopened the case. There were inconsistencies in landlord's rent history records. Further investigation was needed, including a hearing.
