Guardian Appointed for Psychiatric Patients in SRO

LVT Number: 13057

Rent-stabilized SRO tenants sued landlord and HPD for restoration of building services and to prevent landlord from evicting some of them. Tenants' attorney asked the court to appoint a guardian for some of the tenants, who were former psychiatric hospital patients released to residency at the SRO. Tenants each signed a statement that they understood what a guardian was and that they needed one to help make decisions related to the court case. Landlord opposed tenants' request. The court ruled for tenants, who presented sufficient proof that they needed a guardian.
