Garage Space Is Base Date Service

Tenant complained of a rent overcharge. He was charged $27 per month for a garage space when he moved in and was now charged $100. The DRA ruled for tenant, finding that the garage space was a base date service and that there was an overcharge. Landlord appealed. The DHCR ruled against landlord. There was no question that tenant received a parking space from landlord when he moved into the apartment. Landlord submitted no proof that parking wasn't a base date service.
