Fuel Cost Adjustment Increase Granted

Tenant challenged the 2005 fuel cost adjustment granted to landlord. The DRA ruled for tenant, finding that the $45 increase that landlord charged tenant was an overcharge. Landlord appealed and won. The DHCR reviewed the fuel cost adjustment history for the building from 1980 through 2005, and found that the cumulative increase per room was $15.06. The legal increase for tenant's three-room apartment, therefore, was $45.18 per month. Since landlord charged tenant $45.09 per month, there was no overcharge.
