Fuel Cost Adjustment Granted

LVT Number: #22807

Tenant challenged landlord's 2010 fuel cost adjustment report. Tenant claimed no adjustment should be permitted because superintendent services weren't provided at the building. The DRA ruled against tenant, who appealed and lost. There had been no complaint and no DHCR determination that essential services weren't being provided at the building. So landlord wasn't barred from collecting the fuel cost adjustment.
