Four Scheduled Cleanings per Day Was Sufficient

DOS issued a violation notice to landlord for having a dirty sidewalk, noting scattered litter and debris in front of the building. Landlord stated that his employee swept the sidewalk four times a day at set times, but that on this particular day his schedule was delayed given other duties. The ALJ ruled against landlord and fined it $50, finding that landlord was responsible for keeping the sidewalk clean. Landlord appealed. ECB ruled for landlord and revoked the fine. Landlord's cleaning schedule showed landlord made reasonable efforts to maintain the sidewalk.
