Floor Tile Condition Not De Minimis

Tenants complained of a reduction in building-wide services based on the condition of the hallway floor tiles. The DRA ruled for tenants and reduced their rents after an inspection found that the hallway floors were in very poor condition. Landlord appealed, claiming that any problem with the floor tiles was a minor condition and no rent reduction was warranted. The DHCR ruled against landlord. Floor tiles were not only mismatched but also were loose, contained gaps, were missing, and weren't level. This indicated potential health or safety issues.
