Floor Condition Not De Minimis

Rent-stabilized tenant complained of a reduction in services based on the condition of his apartment floors. The DRA ruled for tenant and reduced his rent. Landlord appealed and lost. Landlord argued that worn and dirty wood floors were a de minimis condition that didn’t warrant a rent reduction. But DHCR inspection showed that the parquet wood floor had worn and stained boards that had small holes and nicks and silver taped areas. The condition was not de minimis.
