First Rent over $2,000 per Month

LVT Number: 16021

(Decision submitted by Karen Rakowski of the Manhattan law firm of Belkin Burden Wenig & Goldman, LLP, attorneys for the landlord.) Tenant complained of a rent overcharge. The DRA ruled against tenant. A review of the four-year rent history showed that the apartment was vacant on the Dec. 15, 1997, base date. The first rent after that was prior tenant's rent of $2,050 in 1998. The complaining tenant's first rent was $2,725. Since the base rent in 1998 was over $2,000, the apartment was deregulated, and tenant can't claim a rent overcharge.
