First Rent Is $2,000 per Month or More

Rent-stabilized tenant lived in Apartment A, with a monthly rent of $960. Apartment B, next door, rented for $1,000. When it became vacant, tenant asked landlord if he would combine the two apartments and let tenant rent new Apartment A/B. Tenant said that he was willing to pay the fair market rent. Landlord asked the DHCR if tenant would still be rent stabilized. In an opinion letter, the DHCR said that tenant couldn't waive his rent-stabilized coverage. But if landlord combined the apartments, the new legal rent would be over $2,000 and the apartment would be deregulated by law.
