First Inspection Report Missing

In October 1985, tenants complained of a building-wide service reduction based on a number of conditions. An inspection in May 1987 showed that none of the claimed conditions existed, so the DRA ruled against tenants. One tenant appealed, claiming that a prior DHCR inspection was done in May 1986 and that conditions existed at that point. The DHCR couldn't find a copy of any such inspection report, although its records showed that an inspection requested in April 1986 was done in late May 1986. The DHCR wouldn't speculate as to what was in that report.

This showed that landlord had made prompt and effective efforts to maintain required services at the building. It also wasn't necessary to give tenants notice of either an inspection nor to give them copies of the inspection reports for comment before the DRA's order was issued.
