First-Floor Tenant Benefits from Elevator Upgrade

Landlord applied for MCI rent hikes based on an elevator upgrade. The DRA ruled for landlord. Tenant appealed and lost. Tenant said that because she lived on the first floor of the building at the lobby level, she didn't use the elevator and should not have to pay an MCI rent hike for this improvement. The DHCR said that tenant didn't have to use the elevator to benefit from it. All tenants benefited directly or indirectly from the elevator installation.
