Fireplaces Are Working

Tenant complained of a reduction in services, claiming that fireplaces in his apartment didn't work. The DRA ruled for tenant and reduced his rent. Landlord later applied for rent restoration based on restoration of services. The DRA ruled for landlord. Tenant appealed, claiming that landlord had notified all tenants not to use fireplaces during repairs. The DHCR ruled against tenant. Landlord stated in its rent restoration application that fireplaces were now working. So the prior notice to tenants was no longer in effect.
