Fire Extinguisher Required During Building Demolition

DOB issued a violation notice to landlord's contractor for failing to have a fire extinguisher at a building during demolition. The contractor argued that, on the date of the violation, demolition work hadn't started and workers were putting a fence up around the building. The ALJ believed the contractor but found that it was still in violation of the Building Code. The contractor, which was fined $1,600, appealed and lost.

The contractor argued that, on the date of the violation, demolition work hadn't started and workers were putting a fence up around the building. The ALJ believed the contractor but found that it was still in violation of the Building Code. The contractor, which was fined $1,600, appealed and lost. The Building Code required compliance with Fire Code Section 1415.1, which required that buildings or structures under construction, alteration, or demolition must have at least one portable fire extinguisher on site. Even if demo work hadn't yet started, the site contained combustible materials and no fire extinguisher.
