Fire Escape Extension Doesn't Qualify

Landlord applied for MCI rent hikes based on a number of improvements, including the installation of a fire escape. The DRA ruled that landlord couldn't collect a rent increase for the fire escape. Landlord appealed and lost. Landlord hadn't completely replaced the fire escape. Instead, landlord had installed a new section of the fire escape to extend it from the enclosed backyard through the basement to the street. So landlord wasn't entitled to any MCI increase for this work.
