Final Payment Doesn't Extend Two-Year Filing Deadline

Landlord applied for MCI rent increases based on a number of improvements. The DRA disallowed any increase for the new burner landlord installed because landlord's application was filed more than two years after the burner installation was completed. Landlord appealed, claiming that the application was filed within two years of its final payment to the contractor for the burner installation. The DHCR denied landlord's PAR. The two-year period for filing starts on the date the installation is completed---not the date final payment is made.
