Tenant complained of a reduction in services based on exposed and scattered trash outside his apartment window. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that on the date of the inspection, the building super simply had been called away on an emergency and hadn't finished his work for the day. The DHCR ruled against landlord.

Tenant complained of a reduction in services based on exposed and scattered trash outside his apartment window. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that on the date of the inspection, the building super simply had been called away on an emergency and hadn't finished his work for the day. The DHCR ruled against landlord. An inspection showed that garbage was piled up outside tenant's bedroom window, that garbage was exposed and scattered all over the floor in the garbage area, that garbage bins weren't covered, and that there was a very foul odor outside tenant's apartment.
