Equipment Bought in Bulk

Tenant complained of a rent overcharge. Landlord claimed new equipment had been installed. The DRA found that landlord didn't prove the cost of the improvements, and ruled for tenant. Landlord appealed. Landlord had submitted a written tenant consent to a rent increase for improvements. Landlord's paid invoices were for appliances bought in bulk; no specific apartments were listed. But, tenant admitted getting a new refrigerator and dishwasher, and an inspection showed there was also a new kitchen sink. The DHCR granted rent increases for these items.

No increase was allowed for a new kitchen floor because there was a gap in the linoleum and because a linoleum floor is considered ordinary maintenance and repair---not an improvement.
