Engineer's Fees Included in MCI Increase for Work Needed for LPC Approval

Landlord applied for MCI rent hikes based on pointing, parapet installations, engineering fees, consultant fees for the pointing, an asbestos survey, and asbestos removal. The DHCR ruled for landlord and approved the MCI increase. Tenants appealed and lost.

Landlord applied for MCI rent hikes based on pointing, parapet installations, engineering fees, consultant fees for the pointing, an asbestos survey, and asbestos removal. The DHCR ruled for landlord and approved the MCI increase. Tenants appealed and lost. Among other things, tenants argued that the engineering fees should've been disallowed because pointing and parapet installations weren't complex work requiring an engineer.  But, due to the complexity of requirements for compliance with Landmark Preservation Commission prerequisites, the engineer's proposal, contract, and construction documents for the pointing and parapet work were substantiated.
