Elimination of Live-in Super Isn't a Reduction of Services

Rent-stabilized tenant complained of a reduction in building-wide services after landlord eliminated live-in superintendent service. The DRA ruled against tenant, finding no reduction in services. Tenant appealed and lost. It is long-standing DHCR policy that, by itself, discontinuing live-in super service doesn't constitute a reduction in services unless there is also a reduction in provided janitorial service at the building. The DHCR found no reduction in janitorial services at the building, and there were no HPD or DOB violations.
