Elevators Working Properly at Time of DHCR Inspection

Tenants complained of a reduction in building-wide services based on interruptions in elevator service. The DRA ruled against tenants after inspection showed that the two elevators were working. Tenants appealed and lost. They argued that a single inspection was insufficient to determine whether the elevators worked on a regular basis. But it wasn’t DHCR’s policy to conduct multiple inspections to verify a particular complaint.

Tenants appealed and lost. They argued that a single inspection was insufficient to determine whether the elevators worked on a regular basis. But it wasn’t DHCR’s policy to conduct multiple inspections to verify a particular complaint. The DHCR’s inspector reported that the elevators were operating normally, that tenants had access to both elevators through the lobby, that the elevators ascended and descended smoothly and stopped at every floor, with floor notifications, and that each elevator cabin had a camera, a mirror, and a ventilation fan.
