Elevator Working at Time of DHCR Inspection

Tenants complained of a reduction in building-wide services based on an elevator leveling problem. The DRA ruled against tenants and dismissed the complaint. Tenants appealed and lost. They claimed that landlord had admitted in writing that there was an issue and tenants submitted proof of landlord's prior attempts to fix the elevator. But in response to tenants' complaint, landlord stated that the elevator was in the process of an upgrade and had notified tenants in writing. The DHCR inspected the elevator twice.

In April 2012 the elevator cab wasn't in service as it was being upgraded. In July 2012, the elevator was working properly. So tenants' complaint was properly dismissed.
