Elevator Upgrading Wasn't Piecemeal

Landlord applied for MCI rent increases based on elevator upgrading. The DRA granted landlord an increase for a new elevator controller/selector, but denied any increase for elevator cab refurbishment and installation of a vandal-proof push-button station. The DRA found that these components of the elevator upgrading weren't done within a reasonable time of installation of the controller/selector. Landlord appealed. The DRA stated in its order that the controller/selector was installed two to three years before the other components. But this was incorrect.

The controller/selector and push-button station were installed in 1985; the cab refurbishment was completed in 1986. Since this work was either in progress or completed within months of the other work, it wasn't a piecemeal improvement. The DHCR ruled for landlord.
