Elevator Shaft Reconstruction Included in MCI

Landlord applied for MCI rent hikes based on elevator upgrading. The DRA ruled for landlord in part, denying any increase for the portion of the cost allocated to demolition and reconstruction of an elevator shaft, and for engineer, architect, and consultant fees. Landlord appealed and won. Construction of the new elevator shaft normally wasn't considered as other necessary work required for elevator upgrading. But in this case it was required by DOB to support the new elevator installation, which couldn't have been performed otherwise.
