Elevator Repairs Didn't Qualify as MCI

Landlord applied for MCI rent hikes based on elevator work. The DRA ruled against landlord, finding the work to be only maintenance and repair. Landlord appealed and lost. Landlord claimed that it upgraded the elevator. But landlord only installed new hoist cables and a hoist motor. Landlord didn't install a new controller or selector, or obtain sign-off approval from DOB. Therefore, the work didn't qualify as an MCI.
