Elevator Problems

Tenants complained of a reduction in building-wide services. They said that the elevators in each building tower broke down on a weekly basis, and that tenants were without elevator service for two days. Landlord denied any problem and said that the elevators were maintained under a service contract. The DRA ruled for tenants based on an inspection finding that one elevator didn't stop level on all floors and that the cab continuously rose and lowered on each floor. Another elevator was out of service, and two additional elevators were working properly.

Another elevator was out of service, and two additional elevators were working properly. Landlord appealed, arguing that a single elevator breakdown shouldn't warrant a rent reduction. The DHCR ruled against landlord. The DHCR's inspection confirmed tenants' complaint, filed five months earlier. And even while landlord's PAR was pending, various tenants continued to complain that the elevators were still breaking down.
