Elevator Out of Service Temporarily for Maintenance

Rent-stabilized tenants complained of a reduction in building-wide services. They said that the elevator was out of service from May 19 until Aug. 4, 2014. The DRA ruled against tenants, who appealed and lost. Landlord claimed that the elevator was out of service temporarily during required maintenance work. And when the DHCR inspected on Sept. 3, 2014, the elevator was working. So tenants couldn’t get a rent reduction for the period when there was no service.
