Elevator MCI Included Plans and Specifications

Landlord applied for MCI rent hikes based on elevator work. The DRA ruled for landlord in part, granting an increase for the elevator upgrade but denying any increase for the cost of plans and specifications. Landlord appealed and won. The cost of landlord's plans and specifications were incurred in connection with the MCI and didn't duplicate other work or costs. This work was necessary and customary for completing an elevator improvement. Notably, landlord and the elevator contractor excluded specifications for the elevator modernization from the scope of work listed in the contract.
