Elevator Light Switch Permanently On

Tenant complained of reduced services building-wide. Among other things, he claimed that the elevator light switch was broken. An inspection showed that the elevator light switch was purposely broken off so that the elevator light would stay on at all times. The DRA reduced tenant's rent, and landlord appealed. The DHCR ruled for landlord. This condition shouldn't be considered a failure to maintain services. On the contrary, the elevator light switch had been intentionally disabled to both maintain the light in the elevator and preserve safety conditions.
