Elevator Installed in Walk-up Building

Landlord applied for MCI rent increases based on the installation of an elevator in a five-story building that previously didn't have one. The DRA denied landlord's application, and landlord appealed. Landlord pointed out that 95 percent of tenants had requested the elevator, which cost $120,000. The DHCR denied landlord's PAR. Since the building had never had an elevator, the new elevator wasn't required for the operation, preservation, or maintenance of the structure and didn't replace an item whose useful life had expired.
