Effective Date of MCI Rent Hike Delayed

Landlord applied for MCI rent hikes based on elevator upgrading, terrace and garage roof installations, and façade restoration. The DRA granted the MCI rent hikes effective Dec. 1, 2007, instead of June 6, 2006, based on landlord’s delay in submitting an electrical sign-off in connection with the elevator upgrade. Landlord appealed and lost. The Certificate of Electrical Inspection or “sign-off” is needed to prove that the new wiring installed in the elevator met safety standards imposed by DOB.

Landlord claimed that the DHCR’s instructions didn’t clearly state that this was required documentation. But the DHCR Form RA-79 Attachment A clearly requires the submission of the certificate for any rewiring. The DRA also had requested this document from landlord three times after landlord’s application was filed.
