The DRA ruled for tenant and reduced his rent. Landlord later applied to restore the rent based on restoration of services. The DRA ruled for landlord and restored tenant's rent effective April 1, 1997. Landlord appealed, claiming that the effective date of the rent restoration should be earlier. The DHCR ruled for landlord.

The DHCR ruled for landlord. Landlord had filed the rent restoration application in February 1995 and prior tenant in occupancy at that time hadn't objected. Since tenant moved into apartment in July 1995, the rent restoration should be effective as of that date.
