Duplicate Rent Reduction Order Still in Place for Tenant Not Covered by First Order

Rent-stabilized tenants complained of a reduction in building-wide services based on loss of elevator service. The DRA ruled for tenants and reduced their rents. Landlord appealed and won, in part. Landlord pointed out that there were already two rent reduction orders in place for lack of elevator service. Only one tenant who signed the current complaint wasn’t named in the prior orders. The DHCR found that only one prior order concerned a rent reduction granted for lack of elevator service.

But the new order was amended so that it applied only to the tenant who didn’t receive a rent reduction for loss of elevator service under the DHCR’s prior order.
