DRA Miscalculated Increases

Landlord applied for MCI rent hikes based on the installation of a new roof. The DRA ruled for landlord. Landlord appealed, claiming that the DRA miscalculated the amount of the rent increases. Landlord pointed out that the DRA didn't include the total annual rents of three decontrolled apartments in the total of the annual residential rent when calculating the commercial tenants' share of the MCI. The DHCR ruled for landlord. Landlord was entitled to an additional $1.80 per room per month in MCI rent increases.
