DRA Improperly Ordered Building-Wide Rent Freeze for Entire Building

Tenant complained that she never received a copy of landlord's April 1, 1984, initial rent registration. The DRA found that landlord didn't register tenant's building on April 1, 1984, or at any time thereafter. The DRA froze the rents of all tenants in the building. Landlord appealed, claiming that all tenants had been served with RR1 forms. The DHCR ruled for landlord in part. There was no proof that landlord had registered the building.

But nothing in the rent stabilization code authorized the DRA to freeze the rents of all apartments in the building based on landlord's failure to prove the registration of the one apartment involved in the complaint. Only the complaining tenant's rent could be frozen.
