DOT Permit Doesn't Exempt Landlords from DOS Regulations

DOS issued violation notices to landlords of six newly built attached houses for not keeping the sidewalks clean. Landlords claimed that DOT had given their general contractor a permit to maintain a work area in front of the buildings during construction. The ALJ ruled against landlords and fined each of them $50. Landlords appealed and lost. The fact that the contractor had a DOT permit to occupy the sidewalk didn't exempt landlords from complying with DOS regulations.
