DOB Revoked Boiler Permit

DOB issued a violation notice to landlord for doing work without a permit. DOB had revoked landlord's boiler permit two months earlier because of noise violations. The new violation was based on installation of the new boiler without a permit. Landlord pointed out that it had a valid work permit in 1990 when the boiler was installed, and that in 1994 it received DOB's letter that the boiler violated noise-control rules and that it responded on time, showing that the boiler was in compliance with the noise-control code. The ALJ ruled against landlord and fined it $350. Landlord appealed.
