DOB Provided No Proof of Claimed Transient Use at Building

DOB issued a violation notice to landlord for illegally converting an apartment building to transient use, as well as related egress and fire alarm system violations. The ALJ ruled for DOB and fined landlord $5,400. Landlord appealed and won. ECB agreed with landlord that DOB's characterization of transient use of one apartment was insufficient. No supporting proof was submitted by DOB to support the charge.
